These Terms and Conditions apply to all quotations, estimates and work arranged through East Kent Repairs. By accepting a quotation, estimate or booking, you agree to these Terms and Conditions.
1. Our Role
East Kent Repairs is a booking and referral service that connects customers with carefully selected, highly skilled, independent local tradespeople.
Once a quotation has been accepted and a tradesperson assigned, the contract for the work is formed directly between the customer and the assigned tradesperson. East Kent Repairs is not the contractor carrying out the work and does not assume responsibility for the workmanship, guarantees or contractual obligations of the assigned tradesperson except where required by law.
2. Quotations and Estimates
All quotations and estimates are based on the information available at the time of inspection or from photographs supplied by the customer.
Hidden defects, concealed damage or additional work may only become apparent once work has commenced. If this occurs, the tradesperson will discuss any additional work and associated costs with you before proceeding.
Quotations are valid for 30 days unless otherwise stated.
3. Acceptance of Work
Acceptance of a quotation confirms acceptance of these Terms and Conditions.
Work will only be scheduled once the quotation has been accepted.
4. Deposits
Certain jobs require a deposit to cover materials, bespoke joinery or specialist orders.
Any deposit amount will be agreed beforehand and paid directly to the assigned tradesperson.
Deposits used to purchase bespoke or non-returnable materials may be non-refundable if the booking is cancelled.
5. Payment
Unless otherwise agreed in writing, payment is due immediately upon satisfactory completion of the agreed work.
Before requesting payment, the tradesperson will explain the work completed and provide the customer with the opportunity to inspect it.
Cash is the preferred method of payment. Bank transfer may also be accepted where agreed.
Failure to make payment when due may result in interest and reasonable debt recovery costs being added where permitted by law.
6. Independent Tradespeople
All work is undertaken by independent self-employed tradespeople.
Each tradesperson is solely responsible for:
The work they carry out.
Their workmanship.
Their public liability insurance.
Any guarantees they choose to provide.
Compliance with relevant legislation and regulations.
7. Guarantees and Documentation
To keep costs as low as possible, East Kent Repairs operates with minimal administration.
If you require a written receipt, workmanship guarantee or additional documentation, this should be requested before work begins and agreed directly with your assigned tradesperson.
8. VAT
Unless otherwise stated, no VAT is charged because the assigned tradesperson is not VAT registered.
If VAT becomes applicable, this will be clearly stated before any work is carried out.
9. Customer Responsibilities
The customer agrees to:
Provide safe and reasonable access to the property.
Ensure sufficient working space is available.
Remove valuables and fragile items from the work area.
Inform the tradesperson of any parking restrictions, permits or access requirements.
Inform the tradesperson of any known asbestos, structural defects, unsafe electrical installations, hazardous materials or other known risks before work begins.
Failure to disclose known hazards may result in delays or additional charges.
10. Hidden Defects
Many timber repairs uncover concealed decay, rot, insect damage or structural defects once existing materials are removed.
East Kent Repairs and the assigned tradesperson cannot accept responsibility for hidden defects that were not reasonably visible during the initial inspection.
Where additional work becomes necessary, no further work will be undertaken until the customer has been informed and has authorised any revised costs
11. Right to Refuse or Suspend Work
The assigned tradesperson reserves the right to refuse, postpone or suspend work where:
The working environment is unsafe.
Dangerous materials are present.
Access is inadequate.
Severe weather makes work unsafe.
Abuse or threatening behaviour is directed towards the tradesperson.
Payment terms have not been met.
12. Delays and Force Majeure
Neither East Kent Repairs nor the assigned tradesperson shall be liable for delays or failure to perform their obligations where caused by circumstances beyond their reasonable control, including but not limited to severe weather, flooding, fire, accidents, illness, supplier shortages, industrial action, power failures, transport disruption or government restrictions.
Where possible, work will be rearranged at the earliest reasonable opportunity.
13. Cancellations
Customers should provide as much notice as possible if cancelling or rearranging an appointment.
Where materials have already been ordered or work has commenced, reasonable costs may still be payable.
Repeated cancellations or failure to provide access may result in the booking being cancelled.
14. Missed Appointments
If the tradesperson attends the property at the agreed time and cannot gain access, or the appointment is cancelled without reasonable notice, a call-out charge may be payable to cover lost time and travel costs. This will be discussed by your tradesperson before work commences.
15. Existing Conditions
Repairs are intended to improve the condition and serviceability of existing items.
East Kent Repairs and the assigned tradesperson cannot accept responsibility for failures arising from pre-existing defects, poor historic workmanship, structural movement, water ingress, timber movement or deterioration outside the scope of the agreed works.
16. Photographs
The assigned tradesperson may take photographs before, during and after the work for record keeping, quotations, insurance purposes and marketing.
No personal information or property address will be published without permission.
Customers may request that photographs are not used for marketing purposes by notifying the tradesperson before work begins.
17. Retention of Title
Any materials or products supplied by the tradesperson remain the property of the tradesperson until payment has been received in full.
18. Liability
East Kent Repairs accepts no liability for work undertaken by independent self-employed tradespeople arranged through its service.
The assigned tradesperson remains solely responsible for the work they undertake.
Nothing within these Terms and Conditions limits or excludes liability where such exclusion is prohibited by law.
19. Complaints
Customers should first raise any concerns directly with the assigned tradesperson, allowing them a reasonable opportunity to inspect and rectify the issue.
Where requested, East Kent Repairs will assist in facilitating communication between both parties but cannot guarantee any particular outcome.
20. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
21. Customer Acceptance
By accepting a quotation, paying a deposit, booking an appointment or allowing work to commence, the customer confirms that they have read, understood and accepted these Terms and Conditions in full.
